Gift A Feast recognizes and respects the importance of maintaining the privacy of our customers, registered members ("Members") and users, and is committed to using your information responsibly. The purpose of this Privacy Policy is to inform you of:

·      what information we may collect from you when you visit our Web Site, respond to our emails, place orders via phone, mail or fax, use our mobile applications, place orders through social media applications or otherwise contact us via telephone, email, or mail (collectively, our "Services"),

·      how we use it, and

·      the choices you have regarding our use of personal information you have provided.

This Privacy Policy is part of the Terms of Use, which governs your use of our Website located at www.giftafeast.com.  Any dispute over privacy is subject to this Privacy Policy and our Terms of Use. 

SECTION 1 – WHY DO WE GATHER INFORMATION?

Gift A Feast gathers personal information to help improve our products and customer service, to communicate with you, to process your orders, to provide an enhanced and more personalized shopping experience and to inform you, and your gift and message recipients, of special offers and discounts from us and selected third parties.

SECTION 2 - WHAT INFORMATION DO WE GATHER?

We collect information through our Website, emails, mail, telephone, mobile applications and social media applications including when you:

·      browse our store,

·      return an item or make an exchange,

·      inquire about our products,

·      subscribe to receive communications from us via email or register an account on our Website,

·      participate in one of our surveys or marketing events,

·      are referred to us through a marketing promotion of third-party business relationship,

·      are sent our products as a gift,

·      submit information for employment consideration, and

·      engage in any activities we make accessible to our customers, members or users, including content submissions, chats, discussion groups, and requests for suggestions

 

Depending on how you interact with us, we collect some or all of the following types of information:

·      your name, address, telephone number, email address,

·      username, password, answer to security questions,

·      payment/ordering information (credit/debit card number, expiration date, alternate or additional billing information and billing address),

·      gender and birth date, if you choose, or are otherwise required to, enter such information,

·      products purchased and occasion type (for example, Mother's Day),

·      any promotion or gift card code and related information,

·      message and gift recipients' names, addresses, telephone numbers and email addresses,

·      Information about your company or business,

·      other information you provide to us, including User Submissions (defined in the Terms of Use), and

·      your computer’s internet protocol (IP) address and the name of the web page directing you.

 

We also may gather information about how visitors navigate through our Websites by using clickstream data gathered with “cookies” and/or other online tools such as “pixel tags.”  See Section 3 – Cookies for further information. 

Information you provide to us may be collected by us even if an order, registration, or other process is started but not completed or otherwise cancelled. Members may also add to their Address Book the name, address and telephone number of friends or other persons to whom they may wish to send gifts or expressions. Other Members do not have the right to view and edit your Address Book entries.

SECTION 3 - COOKIES

A "cookie" is a small data file sent to your browser from a web server and stored on your computer. We use cookies to let us know that you are a prior customer, user or Member and to provide certain features to you. Most web browsers allow you to instruct the browser to prevent the use of cookies. However, if you disable this feature, certain aspects of the Services, such as the shopping cart, may not function properly.

We have relationships with third parties who may receive non-personal information directly from the cookies placed by our Services on your computer to assist in analyzing our business and customers.

Our Services may also use a common web technology "called "action tags" (also called single pixel gifs or web beacons) to anonymously track purchase, usage and other web activity information. Action tags may be used to provide data to third parties for tracking purposes. However, our Services do not use action tags to collect or transfer personal information. NEWMESSAGE Indicates whether a new message has been received.
NO_CACHE Indicates whether it is allowed to use cache.
PERSISTENT_SHOPPING_CART A link to information about your cart and viewing history if you have asked the site.
POLL The ID of any polls you have recently voted in.
POLLN Information on what polls you have voted on.
RECENTLYCOMPARED The items that you have recently compared.
STF Information on products you have emailed to friends.
STORE The store view or language you have selected.
USER_ALLOWED_SAVE_COOKIE Indicates whether a customer allowed to use cookies.
VIEWED_PRODUCT_IDS The products that you have recently viewed.
WISHLIST An encrypted list of products added to your Wishlist.
WISHLIST_CNT The number of items in your Wishlist.

SECTION 4 – INTEREST-BASED ADVERTISING

Advertisements for our products and services may appear on third party websites around the Internet. Some websites and services deliver these advertisements based upon data that has been previously collected about your past behavior online. For example, if you have viewed websites about gift baskets, these websites or services may display to you an advertisement for our gift baskets. This kind of targeted advertising is sometimes called interest-based or online behavioral advertising. It is generally not based upon your personal information, but rather, upon your online activities.

We do not control such third party websites or services on which these advertisements appear. Further, we do not control how they collect and use data about your online activities. If you opt-out, you will still receive advertisements, but they will not be delivered to you based upon your behavioral data possessed by the companies from whom you have opted-out. This process relies upon an opt-out cookie, so if you delete your cookies or use a different computer, you will have to repeat this process.

SECTION 5 – HOW WE USE THE INFORMATION WE COLLECT

The use of your information is subject to the privacy policy and terms of use in effect at the time you use this Website.  We collect information that allows us, among other things, to:

·      contact you regarding the processing of your order

We may use aggregated data that does not identify you personally for any purposes, including without limitation, research, commercial purposes or improving our Website. For example, we use demographic information gathered via Google Analytics Demographics & Interests reports to gain a deeper understanding of the visitors to our website.

We reserve the right to disclose information you provide to us as required by law, in response to legal process and law enforcement requests and as necessary or appropriate, in our view, to operate the Services, process orders or registrations, to conduct promotions, contests, and sweepstakes you participate in, to protect the rights or property of the Company, its users, customers, recipients, licensors, content or service providers, and if you violate our Terms of Use.

Please note that any personal information you reveal or post on one our public forums (as defined in the Terms of Use), such as a message board, chat room, discussion group, folder, survey, contest, sweepstakes, user review and rate forum, and all User Submissions, are not protected by this Privacy Policy and may be collected, shared and used by us and with third parties, including to contact you. Information you give out or post on our public forums you disclose at your own risk.

SECTION 6 - CONSENT

How does Gift A Feast get your consent?

When you provide Gift A Feast with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. 

We will not use your personal information for a secondary reason, like marketing, unless we ask you directly for your expressed consent, or provide you with an opportunity to say no.

SECTION 7 - PAYMENT

If you choose to complete your purchase using a credit card, then our payment processor, Authorize.Net LLC ("Authorize.Net"), stores your credit card data, email address, mobile phone number, and billing and shipping address. Although no data transmission can be guaranteed to be 100% secure, Authorize.Net and its parent corporation, CyberSource Corporation ("CyberSource"), are committed to privacy and security. CyberSource is compliant with the Payment Card Industry Data Security Standard ("PCI DSS") as a Level 1 service provider. CyberSource has been compliant with PCI DSS since its inception in 2002. PCI DSS is the bankcard industry's most stringent security standard. Examples of CyberSource's security measures include: physical, electronic, and procedural safeguards; sophisticated security monitoring tools; documented security policies; use of strong encryption for transmissions of Order Information to and from CyberSource Customers; restricting access to personally identifiable information; and, periodic security audits by third party security experts. Order Information is maintained in servers located within the U.S.A. and may also be maintained in servers located in Europe or Asia, depending on where the order originates or the geographic location of a CyberSource Customer. SECTION 8 - THIRD-PARTY SERVICES

We may partner with third-party providers to provide specific services to us, such as credit card processing, shipping, promotional or other support services.  In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 9 - SECURITY

We take reasonable precautions and follow industry best practices to protect your personal information, and to ensure that it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL).  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

You play a significant role in protecting your information.  After you register on our Website you are responsible for protecting the security of your username and password. You are responsible for any transaction made using your username and password.

SECTION 10 - AGE OF CONSENT

 By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
